Terms of Service

Important Notice: These Terms of Service govern your use of services provided by Bionic Joints. Please read these terms carefully as they contain important information about your rights and obligations.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Bionic Joints, a medical and aesthetic practice located in Orlando, Florida. By accessing our services, scheduling appointments, or receiving treatment at our facility, you agree to be bound by these terms and all applicable laws and regulations.

If you do not agree with any part of these terms, you should not use our services or access our facilities.

2. Description of Services

Bionic Joints provides medical and aesthetic services including but not limited to:

  • Joint pain management and treatment
  • Regenerative medicine procedures
  • Aesthetic and cosmetic treatments
  • Medical consultations and evaluations
  • Wellness and preventive care services
  • Other medical services as determined appropriate by our licensed practitioners

All services are provided by or under the supervision of licensed medical professionals in accordance with Florida state regulations and medical standards.

3. Patient Responsibilities

3.1 Medical History and Information

You are responsible for providing complete, accurate, and truthful information regarding your medical history, current medications, allergies, and any other relevant health information. Failure to disclose pertinent medical information may result in complications and affects the quality of care we can provide.

3.2 Following Medical Advice

You agree to follow all pre-treatment and post-treatment instructions provided by our medical staff. This includes but is not limited to medication protocols, activity restrictions, and follow-up appointment requirements.

3.3 Appointment Policies

You are responsible for arriving on time for scheduled appointments and providing adequate notice for cancellations or rescheduling as outlined in our appointment policies.

4. Appointment and Cancellation Policy

4.1 Scheduling

Appointments may be scheduled by phone, online portal, or in person. We recommend scheduling in advance to ensure availability for your preferred time and date.

4.2 Cancellation Requirements

Cancellations must be made at least 24 hours in advance of your scheduled appointment time. Cancellations made with less than 24 hours notice may be subject to a cancellation fee.

4.3 No-Show Policy

Patients who fail to appear for scheduled appointments without prior notice may be charged a no-show fee and may be required to prepay for future appointments.

4.4 Late Arrival

Patients arriving more than 15 minutes late may need to reschedule their appointment depending on provider availability and schedule constraints.

 

5. Payment Terms and Financial Policies

5.1 Payment Due

Payment for services is due at the time of service unless other arrangements have been made in advance. We accept cash, credit cards, debit cards, and other approved payment methods.

5.2 Insurance

If you have insurance coverage, we will verify your benefits and file claims on your behalf when applicable. However, you are ultimately responsible for all charges not covered by your insurance plan.

5.3 Cosmetic and Elective Services

Cosmetic and elective aesthetic procedures are typically not covered by insurance and payment is required prior to or at the time of service.

5.4 Refund Policy

Refunds for medical services are handled on a case-by-case basis and are subject to the specific circumstances of each situation. Refunds for cosmetic services may be limited based on the nature of the treatment provided.

6. Informed Consent and Medical Risks

You understand that medical and aesthetic procedures carry inherent risks and that no guarantee of specific results can be made. Prior to any treatment, you will receive detailed information about:

  • The nature of the proposed treatment
  • Expected benefits and potential risks
  • Alternative treatment options
  • Potential complications or side effects
  • Post-treatment care requirements

Your informed consent will be obtained before proceeding with any treatment, and you have the right to ask questions and seek clarification about any aspect of your care.

7. Privacy and Confidentiality

Bionic Joints is committed to protecting your privacy and maintaining the confidentiality of your protected health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable privacy laws.

Our Privacy Notice, provided separately, details how your health information may be used and disclosed, and your rights regarding your health information.

Photography or video recording of treatments may be performed for medical documentation purposes or with your explicit consent for educational or marketing purposes.

8. Limitation of Liability

To the fullest extent permitted by Florida law, Bionic Joints’ liability for any claims related to your treatment or services provided shall be limited to the amount paid for the specific service giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost wages, emotional distress, or loss of enjoyment of life, except as may be required by applicable law.

9. Medical Emergencies

Bionic Joints is not an emergency medical facility. In case of a medical emergency, you should call 911 or go to the nearest emergency room immediately.

For urgent medical concerns related to your treatment outside of normal business hours, follow the emergency contact procedures provided to you or contact our office for guidance.

10. Termination of Treatment Relationship

Either party may terminate the doctor-patient relationship at any time, subject to applicable legal and ethical obligations. Bionic Joints reserves the right to discharge patients who:

  • Fail to comply with treatment plans or follow medical advice
  • Engage in disruptive, threatening, or inappropriate behavior
  • Fail to meet financial obligations
  • Violate practice policies

In the event of termination, we will provide you with reasonable notice and assist in transferring your care to another appropriate provider when medically necessary.

11. Compliance with Laws and Regulations

Bionic Joints operates in full compliance with all applicable federal, state, and local laws and regulations, including:

  • Florida medical practice regulations
  • FDA regulations for medical devices and treatments
  • HIPAA privacy and security requirements
  • OSHA safety standards
  • State Board of Medicine guidelines

Patients are expected to comply with all applicable laws and regulations while receiving services at our facility.

12. Facility Policies

12.1 Conduct

All patients and visitors are expected to maintain appropriate behavior while on the premises. Disruptive, threatening, or inappropriate conduct will not be tolerated and may result in termination of services and removal from the facility.

12.2 Personal Property

Bionic Joints is not responsible for lost, stolen, or damaged personal property. Patients are advised not to bring valuable items to appointments.

12.3 Smoking and Substance Policy

Our facility is smoke-free. Patients under the influence of alcohol or illegal substances will not be treated and may be asked to leave the premises.

13. Communication and Contact

Right to Alternative Communications

Bionic Joints may communicate with you via phone, email, text message, or postal mail for appointment reminders, treatment follow-up, and practice-related matters. By providing your contact information, you consent to receive such communications.

14. Dispute Resolution

Any disputes arising from or relating to these Terms of Service or your treatment at Bionic Joints shall be governed by the laws of the State of Florida.

We encourage patients to communicate concerns directly with our practice management team to resolve issues promptly and amicably. Any legal proceedings shall be conducted in the appropriate courts of Orange County, Florida.

15. Modifications to Terms

Bionic Joints reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting of the revised terms on our website or upon notice to patients through other appropriate means.

Continued use of our services after changes have been posted constitutes acceptance of the modified terms.

16. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

17. Entire Agreement

These Terms of Service, together with our Privacy Notice and any specific treatment consent forms, constitute the entire agreement between you and Bionic Joints regarding the use of our services and supersede all prior or contemporaneous communications and proposals.
